a homicide. patty lee, ktvu channel 2 news. in sunnyvale police are reporting the death of a man who threatened an officer with a hammer and shot by police. officers responded to a 911 call about a man assaulting his mother. when they arrived officers found the man in the street and told him to put down the hammer but he charged at them and that is whether theyope -- when they opened fire. police are looking for two men who robbed a gas station today about 5:30 a.m. this morning. police say one demanded money while a second man pulled out a gun. both robbers werethol,thol -- were tall, thin and african american. they both ran away. oom members of the board -- tomorrow members of the board

of supervisors are going to discuss changes regard credit card use. this comes after he misused public money with his county credit card. among the changes are a requirement for written receipts and submitting receipts. u.s. airlines continues to set new records. airlines received $924 million in baggage fees. that is up 3% from last year. delta and united collected the most at $187 million for united and delta 663 million this year. because of the rain drivers had to deal with wet road today over the bay area. this is highway 17 in the mountains. the wet roads led to a few fender benders on roadways.

flames broke out at 7:30 this morning. everybody got out okay. firefighters had the fire out in 15 minutes. san francisco firefighters carried out a strange rescue this morning. it involved a man and a chimney and no, he wasn't dressed as santa claus. >> i am not sure how he entered. >> the man slid down 6 floors inside the chimney from the roof of an apartment building and he got stuck near the bottom. neighbors called 911. firefighters had to dismantle part of the chimney and then use special equipment to get him out. >> when we arrived we found one person inside of a -- the fire chimney here. had to free some of the bricks to get him out. >> the man was rushed to the

hospital. he is expected to be okay. investigators aren't saying why he was in the chimney but he was not trespassing. president obama and speaker of the house john boehner held talks today to work out a deal to avoid the so-called fiscal cliff. john boehner didn't speak to reporters after the meeting with the president but he offered to accept one of the president's demand, higher taxes on the rich. push to spare mental health from fiscal cliff cuts. programs that provide mental health screenings, case management and funding for medication could be on the line. advocates say the massacre in connecticut shows why the services are crucial. >> that shows up all over the community, not only in schools but also in hospital emergency

a teen accused of shooting at a couple and steeling a car was denied separate trials today. the attorney argued there was no connection between the two crime. he stole a car to impress a girl and then shot at the truck she was riding in when she rejected him. he is held on $2 million bail. police are looking for the man who robbed a wells fargo bank over the weekend. they revested this photo today. -- released this photo today. it happened before 2:00 p.m. saturday afternoon. the man demanded money and made off with cash. he threatened the teller with a gun although a gun was not visible. the fbi has been called in to
